Count Studio for iPhone and iPad, and countstudio.app with it, come from Kallos Labs LLC, called “Kallos Labs” or “we” below. What follows is the agreement you make with Kallos Labs for both, and it holds from the first time you install or open the app.
Flash mode and practising safely
Flash mode turns the whole screen into a light that blinks on the count, and a photosensitivity warning comes with it in the app. Fast, bright flashes can bring on a seizure where someone has photosensitive epilepsy. Keep Flash mode off if that could apply to you, or to someone else in the room who is facing the screen. Warm up first, give yourself clear floor, and dance within your body’s limits. Count Studio is a timekeeping aid for rehearsal: it is not a technique teacher and it offers no medical advice.
The licence comes from the App Store
Your licence to use Count Studio is the Licensed Application End User License Agreement that Apple publishes at apple.com/legal/internet-services/itunes/dev/stdeula/; these terms come on top of it. If the two ever conflict, Apple’s text wins. Kallos Labs, not Apple, is the one answerable for the app and for supporting it.
Paying for Count Studio Repertoire
Repertoire is one non-consumable purchase. It adds unlimited songs, all six trainers, Mirror, Studio and setlists, and more count sheets. You pay a single time and keep it: nothing is billed monthly, nothing renews, and there is no recurring charge of any kind. Apple sells Repertoire and collects the payment. Family Sharing is switched on, so the family you share App Store purchases with gets Repertoire as well. Apple decides refunds under its own rules, and refund requests go through reportaproblem.apple.com. Moving to another iPhone or iPad? Sign in there using the Apple Account that paid for Repertoire, open Count Studio and choose Settings > Repertoire > Restore.
The songs you count
Bring in only tracks and videos you are entitled to use. The songs stay yours, as do the counts, notes and count sheets you make from them, and Kallos Labs receives none of it.
Passing counts to other dancers
Share links and AirDrop exist so you can hand patterns, presets and count sheets to other dancers; don’t use them to send anything unlawful. You may not copy Count Studio, resell it, or take it apart to reverse-engineer its code.
Counts can be wrong
We offer Count Studio “as is”; no warranty of any sort comes with it. A great deal of care goes into finding beats and keeping time, yet now and then a song can still be counted from the wrong beat, and there may be bugs we have yet to catch.
If a rehearsal goes wrong
Kallos Labs is not liable for losses that follow only indirectly from using Count Studio, a cue missed on stage being one example, within the limits your country’s law places on such exclusions. Your local consumer law may grant rights that no contract can remove, and nothing here takes them from you.
Which law applies
The law of the place where Kallos Labs LLC is registered governs these terms. Where the consumer law of your own country protects you in a way that cannot be waived, that protection still applies.
Changes and questions
Any new version of these terms is posted here, and the date under the heading moves to the day it went up. Questions about them are welcome at contact@countstudio.app.
